By using our website, calling or texting our phone number, or engaging our services, you agree to this Privacy Policy and Terms of Service. If you do not agree, please do not use our services.

We use your information to respond to inquiries, provide quotes, schedule site visits, perform contracted services, process payments, send SMS messages you request through our phone menu, improve our website, and comply with legal obligations.

SMS/Messaging Program:

When you call our business phone and select the quote option, pressing the corresponding key constitutes your express consent to receive one automated SMS message containing a scheduling link at the phone number you called from.

  • Message Frequency: One message per quote request unless you reply or request more.

  • Cost: Standard message and data rates from your mobile carrier may apply. We do not charge you directly.

  • Opt-out: Reply STOP to any message to opt out. You will receive one confirmation and no further messages unless you opt back in.

  • Help: Reply HELP to any message or email willow@whittershardscapes.com.

  • Carriers: Carriers are not liable for delayed or undelivered messages.

  • Privacy of mobile data: We do not sell your information. Mobile phone numbers and SMS opt-in data will not be shared with third parties or affiliates for marketing or promotional purposes under any circumstances.

We share information only with service providers who help us operate (phone/SMS provider, scheduling software, payment processor, accounting software, website host), with subcontractors when necessary to complete a project, when required by law, or in connection with a business transfer. Quotes, Contracts & Services:

Quotes are valid for 30 days and are not binding until a written project contract is signed by both parties. That contract will set the scope, price, schedule, payment terms, and warranty for your specific project and controls over these Terms in any conflict. Changes to scope require a written change order. We are not responsible for delays caused by weather, material shortages, permitting, or other circumstances beyond our control. By scheduling a site visit, you confirm you are authorized to grant access to the property.

Warranties & Disclaimers:

Workmanship and material warranties, if any, are described in the signed project contract. Except as expressly stated in writing, we make no other warranties, express or implied. Our website and content are provided "as is" without warranties of any kind and do not constitute professional advice for any specific project.

Limitation of Liability:

To the fullest extent permitted by law, Whitters Hardscapes shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or SMS communications, and our total liability for website-related claims shall not exceed one hundred dollars ($100). Liability arising under a signed project contract is governed by that contract. You agree to indemnify us from claims arising out of your misuse of the website or violation of these terms.

Website Use & Intellectual Property:

You agree not to use our website for unlawful purposes, attempt unauthorized access, introduce harmful code, or scrape content for commercial use. All website content (text, graphics, logos, project photos) is our property and may not be copied or reproduced without written permission except for personal, non-commercial use. Third-party links are provided for convenience; we are not responsible for third-party sites or their practices.

Governing Law:

These terms are governed by the laws of the State of Iowa. Disputes shall be brought exclusively in state or federal courts located in Iowa. If any provision is found unenforceable, the remaining terms remain in full force and effect.
